Thank you for your correspondence dated 20 and 21 August 2006 to the Prime Minister and Mr Downer concerning the detention of Mr Gao Zhisheng. Your correspondence to the Prime Minister was forwarded to Mr Downer as he has portfolio responsibility for this issue. I have been asked to reply to both of your items of correspondence, on behalf of Mr Downer.
Australia shares your concern about Gao Zhisheng. The Australian Embassy in Beijing has raised his case with the Chinese Government. We have regularly urged China to address continuing deficiencies in its legal processes – to cease the practice of arbitrary detention, to guarantee the right to a fair and impartial trial, and to uphold lawyers' rights to practice freely and without harassment.
The Australian Government also remains concerned about the broader human rights situation in China, including civil freedoms, and does not hesitate to raise these concerns with the Chinese Government. We do this regularly and at senior levels, not only through our Embassy in Beijing and during high-level visits, but also annually at the Australia-China Human Rights Dialogue.
At the last round of our bilateral human rights dialogue in July 2006, we raised our full range of human rights concerns. This included: freedom of expression; freedom of religion; treatment of political prisoners and ethnic minorities; Falun Gong; torture; the death penalty; re-education through labour; labour rights; women's and children's rights; and HIV/AIDs. The Australian delegation specifically called on China to protect those civil and political rights that its constitution is supposed to guarantee.
The Australian Government will continue to raise its human rights concerns with the Chinese authorities. We will also continue to follow Mr Gao's specific case closely.
